A. Per the Supremacy Clause, the federal law preempts the state law unless it is found to violate the 10th Amendment. In order to violate the 10th Amendment the feds have to have created a law that violates the states' ability to make and create their own laws traditionally left to the states. "Traditional" laws are laws usually related to family law, criminal law, etc. But some criminal laws such as the Controlled Substance Act, can be regulated by the feds, because drugs are a commodity and can easily be transported between states. Therfore, the feds can regulate drug laws to some extent because of the Commerce Clause.

How can I tell if the ionizer on my air filter creates ozone?
Q. I know not all ionizer air filters create ozone, and I have pets that I can't have near ozone. Other ions are fine. I just haven't been using the "Performance booster" for fear it creates ozone. I have Holmes HAP412N-U HEPA-Type Mini Tower Air Purifier. Thanks!

A. That's a good question! HEPA filters generally do not rely on external power to ionize the air, and should produce no measurable ozone. Some electrostatic precipitators (and UV germicidal lamps that were used in smoke filters) do make ozone and possibly some nitrogen oxides, which not only damages textiles and rubber products, but even the lungs with extended use. If there is a metal frame or pins with high voltage across it, it's suspect, but if it has an activated carbon filter afterwards, not much ozone should come through. If there is an on/off switch for the ionizer, just leave it off. There are a number of ozone test kits, from a few dollars for one-time paper test strips (probably what you might use) to machines costing hundreds of… [cont.]

Do you think using birth control creates an abortion mentality?

I was having an argument with a friend, and they said that they think birth control creates an abortion mentality - if you do get pregnant whilst using birth control, you are likely to see it as a negative thing (something you were trying to avoid) and therefore want an abortion. I thought that this was a bit of a ridiculous argument, basically it's saying don't use birth control because you still might get pregnant and then you'll want an abortion. If you understand what i mean?? you call it pathetic fallacy when ...for e.g. you are having an arguement and there is a thunderstorm. So you would say the author (or whoever) uses 'pathetic fallacy' here as you can see that there is a thunderstorm whilst (who ever) is having an arguement. As the weather is creating an effect on the mood of the poem.

A. This is a poorly worded question. The Legislative Branch is the only branch that creates actual law. However your question asks about "rules" which is an entirely different matter. Once Congress makes the law, the IRS, which is part of the Treasury Department and under the Executive Branch, creates the implementing rules and regulations based upon their interpretation of the law as written by Congress. The Judicial Branch resolves disputes in the interpretation of the law.
